The Unlawful Internet Gambling Enforcement Act (see full text) was tagged along with an unrelated bill, the Safe Port Act. There was no debate or vote on the Unlawful Internet Gambling Enforcement Act and it passed because the Safe Port Act passed. This is how this far-reaching legislation undemocratically came into existence in the USA.
In essence the Act prohibits the provision of financial instruments for the use of online gambling for USA residents. Financial instruments include credit & debit cards, wire transfers, e-wallets, cheques and cash.
The Act does not prohibit online gambling. In what appears to some as an unconstitutional practice, the Department of Justice has proclaimed it is illegal to gamble online although there has not been any such law passed by Congress or Senate. Sports Betting is prohibited by the antiquated Wire Act.
Recently a swathe of Poker Sites had their assets seized and executives arrested. Despite this intimidation, some online casinos still offer gambling to USA residents. These casinos do not have a presence in the USA and the payment processors and financial instruments are not connected with or based in the USA. These casinos maintain the USA has no control over them and they continue to offer gambling services to USA residents who are not prohibited from gambling online by any law passed by the USA legislature.
